Terms of Sale

These terms apply when you order wine from Brave Horse Winery through this website. Buying from us means you accept them.

You must be 21

You must be at least 21 years old to buy or receive alcohol in the United States. By placing an order you confirm that both you and the person receiving the shipment are 21 or older. Age is verified at checkout and again by the carrier at delivery.

It is a crime to misrepresent your age to obtain alcohol, and to buy alcohol on behalf of anyone under 21.

Who you are buying from

The wine is made and sold by Brave Horse Winery Inc, a licensed California winery. Our federal basic permit is CA-W-25525 and we hold California ABC license 669643.

Orders are processed and fulfilled through Vinoshipper, our compliance and commerce partner. Vinoshipper handles payment, tax calculation, and the state-by-state reporting that direct wine shipping requires. Their terms apply to the transaction alongside ours, and you will see them at checkout.

Where we can sell

Direct wine shipping is legal in some states, restricted in others, and prohibited in a few. We sell only where we are permitted to, and our system will decline an order it cannot lawfully fill. Title to the wine passes to you in California.

You are responsible for knowing whether receiving wine is lawful where you live.

Prices and availability

Prices are in US dollars and are shown before tax and shipping. We make wine in small lots, and a wine can sell out between the moment you add it to your cart and the moment you check out. If that happens we will tell you and refund rather than substitute.

We may correct pricing or product errors at any time, including after an order is placed. If a correction affects your order we will contact you and let you confirm or cancel before charging.

Vintages change

Wine is an agricultural product. Photographs and tasting notes describe a wine as we know it, and each new vintage differs from the last. The bottle you receive will be the current release unless stated otherwise.

Your account and information

Give us accurate delivery information. We are not responsible for an order that goes astray because of an address error, and a shipment returned for that reason falls under the returns policy.

What we are responsible for

If something goes wrong with an order, our responsibility is limited to the amount you paid for that order. Nothing here limits any right you have under California law that cannot lawfully be limited, and nothing here excludes liability for fraud.

The content on this site

The Brave Horse name, the horse mark, our photographs, and our writing belong to us. You are welcome to share a link; please do not reproduce the material commercially without asking.

Governing law

These terms are governed by the laws of the State of California, and any dispute belongs in the courts of Sacramento County.

Changes

We may update these terms. The version in force is the one published when you place your order, and the date at the top of this page tells you when it last changed.
